DON'T ASK, DON'T TELL PART 2
COMMENTARY: ARE SAMPLES RIP-OFFS?
By Bob Dennis

Don't Ask, Don't Tell?

Although the title is "Don't Ask, Don't Tell," I'm not talking about gays in the military.  I am talking about a subject that is almost as controversial - the use of samples in music.

Master P's recording of "100 Miles And Runnin'" is infringing the 1975 George Clinton/Funkadellac  tune, "Get Off Your Ass and Jam."  The producer took a 3 note guitar riff (a half-second) and looped it into a 16 bar "bed" for the rapper. A federal court recently ruled that even though the sample was slowed down and otherwise modified to make it not-recognizable as the Funkadelic recording, it still is infringement.
