9/24/2004:  Since the legal system insists on applying the letter of the law regarding using samples, it may be time for the developing producers to insist on their rights to "Not Tell."  -ed

Don't Tell As A Right

The fifth amendment of our constitution gives us the right to "not incriminate" ourselves.  We can't be forced into saying we did something wrong or illegal and therefore be subject to state sanctions like fines and imprisonment. 

A Clinton-like compromise was reached to let Bill Clinton partially keep a campaign promise; the policy was no one can ask if you are gay (e.g., during recruiting) and you are advised not to "tell." The "Don't Tell" part of Clinton's policy is actually saying, hey - use your rights!
